Mr.Manoj Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-08-2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Bhagwanpur P.S. Case No. 42/2022 dated 15.02.2022 registered for the offence punishable u/s 341, 323, 379, 307, 326, 504 and 506 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, an altercation took place between the informant and the accused persons which was pacified by the nearby people. When the informant's son was going to home after eating food, the co-accused persons, Sujeet Yadav, Pappu Yadav and Rahul Yadav with an intention to kill caught hands of the informant's son and the petitioner stabbed

On seeing this, the co-accused, Sujeet Yadav took Rs. 15,000/- from the pocket of the informant's son and the co-accused, Pappu Yadav snatched gold chain worth Rs. 25,000/-. Thereafter, the injured was taken to the hospital for treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The nature of injury of the injured is simple in nature i.e., incised bleeding wound of size 3'' x 1⁄2 x 0.2" over mid-side of lower chest. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 05.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with Bhagwanpur Hat P.S. Case No. 42/2022.
