Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Sasaram (Muffasil) P.S. Case No. 27 of 2021 registered for offence punishable under Sections 25(1-B) (a), 26 and 35 of the Arms Act, 1959.

As per the allegation, the accused Rishu Kumar was

Some arms and ammunitions, one pistol and one cartridge were recovered from his possession and two persons become successful for fleeing away. Rishu Kumar appraised the name of the petitioner to the police party. He appraised the police party that the pistol belonged to petitioner Haridwar Kumar from whose possession it fell down while he was fleeing away.

Learned counsel for the petitioner has submitted that nothing has been recovered from his possession and his name has figured in the confessional statement of co-accused. He is the person of clean antecedents.

Considering the above mentioned facts and circumstances, especially the clean antecedents of the petitioner, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 27 of 2021, subject to condition as laid down under Section 438 (2) Cr. P.C. Office shall ensure that all defects are removed by the
