2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 191(2), 190, 127(1), 115(2), 74, 109, 303(2), 352 and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, all the FIR named accused persons including these petitioners abused and assaulted the informant with lathi and iron rod. When daughter of informant tried to rescue her father, then petitioners no.1 and 2 and co-accused Shivani Devi assaulted her with lathi. Petitioner no.4 snatched her earring.

4. It is submitted on behalf of the petitioners that allegation of assault is general and omnibus against all the accused persons and no specific overt act has been alleged against these petitioners. There is land dispute between the parties. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Lachhuar Police Station Case No. 220 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
