====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-05-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with Case No. C2/183 of 2019, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case 72 liters of Nepali Saufi liquor was recovered. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 07.04.2019.

Considering the facts that petitioner has no criminal antecedent and he has remained in custody for more than 1 1⁄2 months, let the petitioner named above is directed to be released

Patna High Court CR. MISC. No.34538 of 2019(2) dt.27-05-2019 2/2 on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Addl. Sessions Judge 2nd, CumSpecial Judge, (Excise) Sitamarhi in connection with Case No. C2/183 of 2019.
