The petitioner seeks bail in Buxar (T) P.S. Case No. 379 of 2020, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

246 liters & 28 ml. of illicit foreign liquor has been recovered from a car and this petitioner is alleged to have fled away after seeing the police.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner was not arrested on spot. Petitioner is neither owner nor driver of the vehicle in question. Petitioner has got clean antecedent and he is in custody since 16.03.2021. Investigation is complete.

Patna High Court CR. MISC. No.45230 of 2021(2) dt.15-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, period of custody and clean antecedent of the petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise Act, Buxar in connection with Buxar (T) P.S. Case No. 379 of 2020.
