The petitioner seeks bail in connection with Special Case No.260 of 2020 arising out of Excise P. S. Case No.134 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 05.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 140 litre of country-made liquor from an auto. The petitioner is alleged to be the driver. The learned counsel for the petitioner submits that it

Patna High Court CR. MISC. No.45958 of 2021(2) dt.10-12-2021 2/2 was some passenger, who left the liquor in the auto and fled away when they saw the police, but this fact has been concealed in the F.I.R. and the petitioner has been made an accused. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 05.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Gaya in connection with CIS No.134 of 2021 arising out of Excise P. S. Case No.134 of 2021.

The application stands allowed.
