The challenge in the present writ application is to the election to the post of Block Pramukh of Vidyapati Nagar Prakhand in the district of Samastipur. After some arguments, and in view of the objection raised by the respondents, learned counsel for the petitioner submits that he may be permitted to withdraw the writ petition with liberty to file an appropriate Election Petition

Patna High Court CWJC No.10980 of 2016 (3) dt.06-12-2016 2/2 before the appropriate authority in terms of the statutory provisions.

Having regard to the aforesaid, the writ application stands disposed off as withdrawn with the liberty aforesaid. If an Election Petition is filed by the petitioner within one month from today, along with a copy of this order, the same shall be heard and decided on merits, within the time frame specified.
