2. The petitioners are apprehending their arrest in Jadia P.S. Case No. 208 of 2022 initially registered under Sections 341, 323, 326, 307, 34 of the Indian Penal Code and later on, Section-302 was also added.

3. Allegedly, the occurrence took place on a trivial issue of quarrel of children. It is alleged that the co-accused Bipin Kumar @ Bobby assaulted the son of the informant on his head with iron rod, as a result of which, he sustained bleeding injury and fell on the ground. The petitioner No. 2 is alleged to have grabbed the hair of the informant and threw her on the ground.

4. It has been submitted on behalf of the petitioners that the petitioners who are the mother and the daughter are the ladies of clean antecedent. There is no allegation on the petitioners to

Patna High Court CR. MISC. No.34630 of 2025(4) dt.18-11-2025 2/2 assault the deceased. The allegation of assaulting the deceased with iron rod is only against the co-accused Bipin Kumar @ Bobby. These petitioners have falsely been implicated in the present case merely because they are the mother and the sister of the main accused, Bipin Kumar @ Bobby.

5. Learned counsel appearing for the State, has opposed the prayer for grant of anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Supaul in connection with Jadia P.S. Case No. 208 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of BNSS, 2023.
