JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of petitioner was disclosed by co-accused, Raju Yadav who was caught on the spot.

Admittedly, petitioner was neither caught on spot nor anything was recovered from his conscious possession and the petitioner does not have any criminal antecedent. Moreover, one co-accused, Prakash Yadad having more or less similar allegation has already been granted privilege of bail by a coordinate bench of this court.

Accordingly, the petitioner named above is directed ti be released on bail on furnishing bail bond of Rs. 10,000/_ (ten thousand) with two sureties of the like amount each in connection
