1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Sahebpur Kamal P.S. Case no. 89 of 2024 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on information having been received, a raid was conducted and 157 liters of IMFL was recovered. The petitioner was taken into custody while co-accused owner of the vehicle manage to escape.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He is neither the owner nor the driver of the vehicle in question nor has he concerned with the brick kiln or the seized liquor. He

Patna High Court CR. MISC. No.39481 of 2024(2) dt.03-06-2024 2/2 had gone to purchase the brick from the brick kiln. The petitioner is in custody since 3.4.2024 and he has no criminal antecedent.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the petitioner not having any concern with the vehicle in question from which the alleged seizure was made, his being in custody since 3.4.2024 and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sahebpur Kamal P.S. Case no. 89 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge II, Begusarai.
