Mr. Tarun Prasad Mandal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-11-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that his cousin sister was married to Umesh on 29.05.2021 and after marriage, accused persons, including the petitioners, were torturing her for dowry, it is further alleged

No.36161 of 2022(2) dt.29-11-2022 2/3 that on 06.01.2022, the informant was informed that his sister was seriously ill, accordingly he along with family members reached his sister's place and there he found his sister dead, thus alleges that she was strangulated to death.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that the FIR does not disclose as to what was being demanded in dowry rather a general and omnibus allegation has been alleged that dowry was being demanded, it is further submitted that petitioner nos. 1 and 2 are married nanad (sister-in-law) and live separately from the husband of the deceased and petitioner nos. 3 and 4 are unmarried nanad and allegation against them are general and omnibus in nature, it is also submitted that the husband of the deceased is also availing his remedies available in law.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.36161 of 2022(2) dt.29-11-2022 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ekma P.S. Case No. 7 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
