JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

It happens to be a case of road robbery wherein the miscreants snatched away Rs. 1,65,000/- after assaulting the driver as well as salesman.

At an earlier occasion while rejecting the prayer for bail vide order dated 26.03.2015 under Cr.Misc.No.48947/2014 (Annexure-1), a liberty was granted to the petitioner to renew, in case so desires, after examination of driver as well as salesman. It has been submitted that driver had already been examined and he has been declared hostile (Annexure-3) but the salesman has not been shown as charge-sheeted witness, as such, he has not been produced by the prosecution. The aforesaid fact is further incorporated under para-8 of the petition.

Patna High Court Cr.Misc. No.37619 of 2015 (2) dt.19-08-2015 Accordingly, petitioner, Chhotu Poddar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge, IVth, Sri P.K. Dixit, Katihar in connection with Rautara PS Case No. 46/2014, Sessions Trial No. 176/2015.
