JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-02-2021 The present writ application has been filed for issuance of a direction to the District Magistrate-cumDistrict Compassionate Committee, Bhagalpur to consider the representation of the petitioner for compassionate appointment as the father of the petitioner died in harness on 12.02.2017.

As per the averments made in the writ petition,

Patna High Court CWJC No.10630 of 2020(2) dt.26-02-2021 2/3 the father of the petitioner was working as Nalkup Driver in Minor Irrigation Division, Bhagalpur. He had performed two marriages. The petitioner happens to be the son from the second wife. After death of his father, his mother and the first wife of his father made a compromise wherein the first wife shall receive benefit of pension accrued to the wife of the deceased per month. In the compromise, it has specifically been mentioned that son from the second wife i.e. the petitioner shall claim compassionate appointment.

The learned counsel for the petitioner further submits that petitioner has filed a representation before the District Magistrate-cum-District Compassionate Committee, Bhagalpur for compassionate appointment and the case of the petitioner was placed before the District Compassionate Committee on several dates, but no decision as yet has been taken.

Considering the aforesaid facts, the petitioner is directed to approach the District Magistrate-cum-District

Patna High Court CWJC No.10630 of 2020(2) dt.26-02-2021 3/3 Compassionate Committee, Bhagalpur within a period of three months from today along with all relevant documents and the order of this Court when it is expected from the District Magistrate-cum-District Compassionate Committee, Bhagalpur to take a final decision in this regard within a period of three months thereafter.

With the aforesaid observation/direction, the writ application stands disposed off.
