NILU AGRAWAL ORAL ORDER 17-06-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioners are languishing in judicial custody since 15.12.2018 in connection with Bagaha Patkhauli P.S. Case No. 612 of 2018 for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case as lodged by the police personnel is that the motorcycle of the petitioners was intercepted and in a bag 18 litres of country made liquor was recovered. Accordingly, a seizure list was prepared. It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal antecedent

He submits that the petitioners are languishing in judicial custody since more than six months and have been sufficiently punished. However, learned APP for the State opposes the prayer for bail.

Considering the nature of allegations and the materials on record as well as the period of custody, let the petitioners above named be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Bagaha Patkhauli P.S. Case No. 612 of 2018.
