JUSTICE SUDHIR SINGH ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 395 and 397 of the Indian Penal Code. Allegation is that three accused persons looted money from Ananya Petrol Pump, Ballo Chak and name of the petitioner has surfaced from the confessional statement of the co-accused. It has been submitted on behalf of the petitioner that he is in custody since 23.8.2014. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R.

There is no recovery of any incriminating articles from the possession of the petitioner. Petitioner has been named on the basis of confessional statement of the co-accused, Amarjeet Kumar @ Ajeet Kumar. T.I.P. is said to have been conducted after a period of two months in custody. Hence, same has got no relevance in the eye of law.

On behalf of the State, it is submitted that petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur, in connection with Dalsingsarai P.S. Case no. 341 of 2013.
