According to the prosecution case itself, co-accused Lakhindra Paswan was arrested on the spot and disclosed the names of his associates but admittedly, at the time of preparation of written report co-accused Lakhindra Paswan did not disclose the name of the petitioner rather it is alleged that in course of investigation, when coaccused Lakhindra Paswan made his confessional statement, he disclosed the name of the petitioner.

No doubt, petitioner carries criminal antecedent but taking into consideration the above stated facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
