Learned counsel appearing on behalf of the petitioner seeks to withdraw the present writ petition with a liberty to prefer appeal before the Additional Chief Secretary, Education Department, Government of Bihar, in accordance with the Bihar Government Servants (Classification, Control & Appeal) Rules, 2005.

Considering the aforesaid submission, the petitioner, if so advised, may prefer appeal before the Additional Chief Secretary, Education Department, Government of the Bihar, who is directed to call for the service particulars relating to the petitioner and necessary orders and see, as to whether, the action taken against the petitioner is sustainable and impugned order contained in Memo No. 279 dated 14.02.2020 can be interfered with and dispose of the appeal preferred by the petitioner expeditiously.

4. The Additional Chief Secretary, Education Department, Government of the Bihar, must consider to condone delay, if any, in filing of the appeal, considering the fact that the entire world was affected by the Covid-19 pandemic and the writ petition was filed in the year 2021 during which period several advisories were issued by the Central Government and the State Government, as well as, by this Court.

5. Accordingly, the present writ petition stands disposed of.
