The petitioners seek bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

The informant named eight persons and alleged that they all assaulted the father of the informant and others and his father died.

It is submitted that firstly Bashistha Yadav was granted bail vide orders passed in Cr. Misc. No. 11770 of 2014 on the basis of which two other accused persons namely Rajendra Mallah @ Praan and Arun Mallah have also been granted bail vide orders passed in Cr. Misc. No. 39351 of 2015. The case of the petitioner

Patna High Court Cr.Misc. No.38505 of 2015 (2) dt.07-09-2015 2/2 stands exactly on the same footing. Eight accused persons are alleged to have assaulted, but the deceased got only two injuries. Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas (Sasaram) in Sasaram (Mufassil) P.S. Case No. 321 of 2013.
