JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but omnibus allegation of firing has been levelled against the petitioner and some other accused. Moreover, there is specific allegation against co-accused, Bhola Yadav, who shot fire on the deceased.

Learned counsel appearing for the petitioner points out that one Ramesh Kumar lodged Daudnagar P.S. Case No. 135 of 2015 for the occurrence of the same day against the prosecution party of the present case as the prosecution party took out a procession and began to pressurize the local shopkeepers to shut down their shops and when the local shopkeepers refused to obey

Patna High Court Cr.Misc. No.36563 of 2015 (2) dt.31-08-2015 2/2 the command, the prosecution party made indiscriminate firing and also caused injuries to several persons by using lethal weapons. It is also pointed out on behalf of the petitioner that for the same occurrence, one Daudnagar P.S. Case No. 133 of 2015 was lodged by the officer in charge of Daudnagar Police Station against the prosecution party as well as accused of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad (Bihar) in connection with Daudnagar P.S.
