JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 384/414 of the Indian Penal Code and section 25(1-A)a of the Arms Act. As per the prosecution case, on the information that accused persons are indulged in demanding rangdari from shop keepers, police conducted raid and apprehended the petitioner and recovered a loaded country made pistol and a motorcycle. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. No substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Charge sheet
Patna High Court CR. MISC. No.45214 of 2021(2) dt.15-11-2021 2/2 has already been submitted. Petitioner has claimed clean antecedent and he is in custody since 19.2.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Muzaffarpur in Brahmpura Police Station Case No. 59 of 2021.
