2. The petitioner apprehends his arrest in a complaint case registered for the offence punishable under Sections 323, 324, 341, 354B, 379, 504 and 34 of the Indian Penal Code.

3. As per complaint case, this petitioner, along with other accused persons named in the complaint petition, abused and assaulted the informant in intoxicated state and snatched her mangalsutra worth Rs. 30,000/-. It is further alleged that when the mother-in-law of the informant came to rescue her, then all the accused persons assaulted her, as a result of which both of them sustained several injuries.

4. It is submitted by learned counsel appearing on behalf of the petitioner that both parties and co-villagers and due to dispute over pathway, a quarrel took place between the parties and taking advantage of the situation, this false and

Patna High Court CR. MISC. No.38003 of 2024(3) dt.03-07-2024 2/2 concocted case has been lodged. It is further submitted that the present complaint case has been lodged after delay of 13 days, without any explanation for the same. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, delay in lodging of the complaint case and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Complaint Case No.2016 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
