The petitioner is in judicial custody in connection with Amnour, P.S. Case No. 68 of 2022 for the offences under Sections 376 (DA), 336, 120(B) and 201/34 of the Indian Penal Code and Section 4/6 of POCSO Act as also Section 67(B) of the Information and Technology Act, 2000.

As per the prosecution story, the informant has alleged that when the couple was out, accused, Ranjan Singh and his friends came inside their house and committed rape with her minor daughter, Anshu Kumari which was also videographed. Patna High Court CR. MISC. No.35803 of 2022(2) dt.20-09-2022 2/2 demanded Rs. 2 lakhs for return of the photos and as they failed to do so, the photography of the victim girl was made viral in the Facebook, Instagram and Messenger etc. Accordingly, the FIR was lodged.

Learned counsel for the petitioner submits that he is the elder brother and had no role to play in the matter. Learned counsel for the informant, on the other hand, dispute the statement made by the learned counsel for the petitioner stating that not only that his brother committed rape upon the victim girl, the same was video-graphed, the petitioner herein, demanded amount and failure to do so, he made the photographs of the victim girl viral on the Facebook, Instagram and Messenger etc.

Considering the gravity of allegation that has been made against the petitioner herein, this Court is not inclined to grant him any relief and the bail application of the petitioner is accordingly rejected.
