2. The petitioner is in custody in connection with Sheikhpura P.S Case No. 86 of 2026 registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per prosecution case, total 5 litres of illicit liquor from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. It is also submitted that petitioner is in judicial custody since 22.04.2026.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that total 5 litres of illicit liquor were recovered from the house of the petitioner which is a joint possession of the petitioner. Petitioner is residing in the joint family in the aforesaid house. Petitioner is in custody since 22.04.2026 and has got only one criminal antecedent as stated in paragraph no. 3 of the bail petition.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court, Sheikhpura in connection with Sheikhpura P.S Case No. 86 of 2026.
