Let the defects be removed within four weeks of the start of the physical Court.
The petitioners are languishing in custody for the offence punishable under Sections 341, 323, 302, 307, 332, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioners is that they thrashed to the mother of the informant into a well.
Submission is that perusal of the entire F.I.R. would reveal that for washing cloth at the said well, a quarrel and abuse started between the parties and in the scuffle, the victim might have fallen in the well. No motive is alleged for
Patna High Court CR. MISC. No.45033 of 2021(2) dt.03-09-2021 2/2 commission of murder in the manner alleged. Petitioners are female. Investigation of the case is already complete. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Barachatti P.S. Case No. 565 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
(c) The petitioners shall not leave the country without permission of the trial Court.
