Let the defect(s), if any, as pointed out by the office, be removed within four weeks.

The case is registered under Sections 363, 366(A) and 120(B) of the Indian Penal Code, in connection with Siwan Town P.S. Case No. 129 of 2020.

As per the FIR, the informant has alleged that the petitioner herein forcibly took the daughter of the informant on a motorbike. When this was informed to the petitioner's family, they were abused.

Learned counsel for the petitioner has drawn this

Patna High Court CR. MISC. No.36417 of 2022(2) dt.20-09-2022 2/3 Court's attention to the statement made by the victim girl after her recovery. As per the said statement, she has narrated that she likes the petitioner herein and she went on her own with him to Banaras and later to Siwan from where straightaway came to the police station. As per the said deposition the girl has been found to be 17 years of age.

Taking into account the aforesaid statement of the victim girl as also the fact that the petitioner has no criminal antecedent, is in custody since 6.5.2022, this Court is inclined to grant him the privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 129 of 2020 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

Patna High Court CR. MISC. No.36417 of 2022(2) dt.20-09-2022 3/3 (iii) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is allowed.
