JUSTICE SATYAVRAT VERMA ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in connection with Narpatganj P.S. Case No. 405 of 2017 instituted for the offences under Sections 147, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.04.2021, charge-sheet has been submitted and charges have been framed.

Learned counsel for the petitioner submits that there is allegation against petitioner of causing injury in the ribs of the son of the informant, namely, Istekhar with arrow. Learned counsel for the petitioner submits that injury on the injured has been found to be grievous caused by a

Case No. 406 of 2017 was instituted against the side of the present informant so there is a case and counter case in which both sides have received injuries. Learned counsel submits that the injured fell while fighting and accidentally an arrow pierced his body as such the assault was not intentional. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.04.2021, charge-sheet has been submitted and charges have been framed as submitted by the learned counsel for the petitioner and is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Narpatganj P.S. Case No. 405 of 2017 provided the learned court below is completely satisfied that the charges have been framed against the petitioner. (Satyavrat Verma, J) Rishi/- U T
