JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 366A and other ancillary sections of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He refers to Section 164 Cr. P. C. statement of the victim in which she has stated that she was in love with the petitioner and had gone with the petitioner out of her own sweet will and has now married with the petitioner. Victim has stated her age to be 18 years. Petitioner has claimed clean antecedent and he is in custody since 13.4.2021. Charge sheet has already been submitted.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.45776 of 2021(2) dt.16-11-2021 2/2 the case and the aforesaid statement of the victim, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII cum Special Judge Katihar in Belon Police Station Case No. 08 of 2021/GR No.230 of 2021.
