Petitioner apprehends his arrest in connection with Maniyari P.S. Case No.84 of 2023 dated 07.03.2023, registered for the offence punishable u/s 30(a) of Bihar Prohibition and Excise Act, pending in the Court of learned Exclusive Special Judge, Excise Court No.II, Muzaffarpur.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek

Patna High Court CR. MISC. No.44404 of 2023(3) dt.29-08-2023 2/2 regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that petitioner has no criminal antecedent.
