The petitioner seeks bail in a case registered under Sections 18(b) & 8(c) of the N.D.P.S. Act.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that 20 kg of opium was said to have been recovered and the same was above the commercial quantity. Hence the petitioner was not entitled for bail under the provisions of Section 37 of NDPS Act.

A report was called for from the trial court. It has been reported that out of nine, one prosecution witness has been examined on behalf of the prosecution. Eight prosecution

Patna High Court CR. MISC. No.34853 of 2020(3) dt.03-03-2021 2/2 witnesses are yet to be examined in the present case. Considering the nature of accusation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer for bail of the petitioner in connection with N.D.P.S. Case No. 09 of 2018 arising out of Excise Case No. 109 of 2018 is rejected. Learned trial court is directed to take all necessary steps and conclude the same preferably within a period of eight months from the date of receipt/production of copy of this order.
