====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and the State through virtual mode.

The petitioner seeks bail in a case initially registered under Sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that petitioner is also one of the persons who is alleged to have fired upon the deceased.

A report was called for from the trial court. It has been reported that the case is pending for hearing of an application filed by the co-accused Dileep Yadav under Section 227 of the Cr.P.C. It is further pointed out that it will take approximately

Patna High Court CR. MISC. No.34114 of 2020(4) dt.30-06-2021 2/2 one year to conclude the trial, if the parties cooperate. Considering the allegation made in the FIR coupled with the fact that the petitioner is one of the assailants, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Gardanibagh P.S. Case No. 176 of 2018 corresponding to Sessions Trial Case No. 624 of 2018 is rejected.

Learned trial court is directed to take all necessary steps to conclude the trial preferably within a period of one year from the date of receipt/production of copy of this order. The District Magistrate and the Sr. Superintendent of Police, Patna are directed to ensure the production of witnesses on the date fixed by the trial court so that the trial could be concluded within the stipulated period of one year. Let a copy of this order be communicated to the District Magistrate and the Sr. Superintendent of Police, Patna for needful.
