Case No. 232 of 2018 registered for the offences punishable under Sections 461, 379 and 411 of the Indian Penal Code. Allegation as per FIR is of committing theft in the shop of the informant and taking away mobile and laptop. Petitioner is not named in the FIR and later his name transpired in the confessional statement of co-accused and during investigation it transpired that one Suresh Prasad had purchased mobile from Haidar Ali, who in his confessional statement has stated that he purchased the same from the petitioner. Submission of learned counsel for the petitioner is that he has been named on the basis of confessional statement of co-accused and the laptop which has been recovered does not
Patna High Court CR. MISC. No.33123 of 2019(2) dt.20-05-2019 2/2 tally with the laptop, description of which has been given in the FIR and he is in custody for about four months and though he has been made accused in one more case but he is on bail in that case.

In view of above facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIII, Saran at Chapra, in connection with Parsa P.S.Case No. 232 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
