JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and informant are co-villagers and submission on behalf of the petitioner is that due to previous enmity, this false case has been lodged against the petitioner. It is further submitted by him that moreover, only Rs. 2,500/- is said to have taken by co-accused, Dilip Singh.

Petitioner carries criminal antecedent of altogether five cases but he is languishing in jail custody in the present case since 20.03.2015 and the investigation against him has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.36615 of 2015 (2) dt.02-09-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Rosera in connection with Singhiya P.S. Case No. 121 of 2014.
