====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-12-2020 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in connection with Rajpur P.S. Case No. 250 of 2019 dated 05.11.2019 instituted for the offences under Sections 392, 411 and 307 of the Indian Penal Code and under Sections 27, 25(1-b)a, 26, 27, 35 of the Arms Act.

Though the petitioner and two others were arrested on the spot by the local population and the police because while looting the informant, a gun shot also was fired, which attracted the local crowd. It has been submitted on behalf of the petitioner that he was apprehended on a mistaken identity and has been falsely framed in this case. One of the similarly situated accused persons

Patna High Court CR. MISC. No.33437 of 2020(2) dt.15-12-2020 2/2 has been granted bail by a Bench of this Court vide 09.07.2020 passed in Cr. Misc. No. 21904 of 2020. The petitioner is in custody since 06.11.2019. Regard being had to the period of the custody of the petitioner and the nature of accusation, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-3rd, Buxar in connection with Rajpur P.S. Case No. 250 of 2019.
