JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the stamp reporter, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Islampur P.S. Case No. 260 of 2020, registered under Sections 341, 323, 498A and 302 of the Indian Penal Code.

The accusation is of killing of Sanjeeta Devi, daughter of informant, Brendra Prasad, by her husband and in-laws due to non-fulfillment of demand of dowry and concealing the dead body

Patna High Court CR. MISC. No.33810 of 2020(2) dt.22-12-2020 2/2 in straw house of her Nanad, Sarita Devi at village Sanda Tar. Learned counsel for the petitioner submits that, in fact, Sanjeeta Devi, daughter of the informant, sustained injury due to falling from the roof, while she was taken at hospital for treatment, but she died. The informant with ulterior motive has lodged the present case with false allegation. Further submission is that petitioner, who is mother-in-law of the deceased, has no criminal antecedent and is in custody since 19.05.2020. Moreover, Ramashray Prasad, husband of the deceased, is in jail custody. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.

10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Hilsa, Nalanda, in connection with Islampur P.S. Case No. 260 of 2020. Out of two sureties, one surety must be the close relative of the petitioner.
