2. The petitioner is apprehending arrest in connection with Katra P.S. Case No.279 of 2021, for the offence punishable under Sections 363, 365, 366A and 34 of the I.P.C.

3. As per the prosecution, the FIR has been lodged against holders of two mobile number with allegation that the accused persons have kidnapped the daughter of the informant with an intention to marry.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that He further submits that petitioner's name has figured in this case only on the basis of suspicion. From the rejection order, it transpires that the victim has already been

Patna High Court CR. MISC. No.36523 of 2025(2) dt.18-06-2025 2/3 recovered and she has narrated her statement under section 164 of the Cr.P.C. that she solemnized marriage with one Raushan Kumar with whom she feel in love since last 3 years.

5. Counsel submits that the criminal antecedent of the petitioner is clean and the only material against the petitioner that he has stopped the victim to not go outside. He further submits that it is the petitioner and his wife used to intimate to the informant about such event, but police upon misinterpretation of the investigation, has figured the name of the petitioner in this case.

6. Counsel specifically pleaded that the accused with whom the victim solemnized marriage, has been granted anticipatory bail vide order dated 16.05.2023 passed in A.B.P. No.1140 of 2023.

7. Learned APP for the State opposes the prayer for bail of the petitioner and submits that antecedent of the petitioner is clean.

8. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand)
