The petitioner seeks bail in Kochadhaman P.S. Case no. 57/2014, registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The petitioner is not named in the FIR. No looted article was recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of coaccused, but the petitioner has not been put on Test Identification Parade. From the possession of the petitioner one loaded country made pistol was recovered after dacoity for which Kishanganj P.S. Case No. 178/2014 was lodged. The petitioner is in jail since 09.03.2015.

Considering the facts aforesaid, the petitioner above named

Patna High Court Cr.Misc. No.39460 of 2015 (2) dt.07-09-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman P.S. Case No. 57/2014.
