The petitioner seeks bail in a case under Section 399, 402 and other sections of the Indian Penal Code, section 25 (1)(b) A, 26/35 of the Arms Act and under section 3⁄4 of Explosive Substance Act.

The petitioner was apprehended along with other accused persons but from the possession of the petitioner red power is said to have been recovered. The powder was not sent for examination. Similarly situated accused have already been enlarged on bail.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each
