The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 1638.16 litres of liquor was recovered from the truck in question of which the petitioner is said to be the khalasi.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or from his truck. The petitioner is in custody since 13.3.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.45559 of 2021(3) dt.21-03-2022 2/2 taking into consideration the facts of the case, the petitioner not having any criminal antecedent and having remained in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Excise P.S. Case no. 83 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Excise, Saran at Chapra.
