JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-08-2019 Petitioner seeks bail in connection with Siwan Muffasil P.S. Case No. 721 of 2018 registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.

Prosecution story is that the petitioner along with other accused persons was coming on a stolen motorcycle and on the way police apprehended them and arrested the petitioner. Submission of learned counsel for the petitioner is that he has no criminal antecedent and he is in custody since 21.12.2018. It is further submitted that similarly situated coaccused persons, namely, Deepak Kumar Sah, has already been granted bail by a co-ordinate Bench of this Court vide order dated 22.05.2015 passed in Cr. Misc. No. 33721 of 2019. Heard learned APP also.

No.33705 of 2019(3) dt.17-08-2019 2/2 In view of above facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Siwan Muffasil P.S. Case No. 721 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
