1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Mahua P.S. Case no. 169 of 2025, registered under sections 191(2), 191(3), 190, 126(2), 127(2), 132, 109, 351(2), 351(3), 352, 249 and 121(1) of the Bhartiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.

As per the prosecution case, the informant states that on having received information that a non FIR accused of Kajipur Sadar P.S Case no. 57 of 2025 namely Suresh Rai having hidden himself in the house of his brother-in-law (sister's husband) Raj Kumar Rai, a raid was conducted. It is stated that on Raj Kumar Rai being requested to permit the search of his house, he along with the members of his family including his six sons and wife who are the petitioners herein assaulted the police personnel and prevented them from performing their official duty. It is further stated that Raj Kumar Rai also resorted to firing on the police personnel.

Learned counsel for the petitioners submits that the petitioners along with Raj Kumar Rai have been falsely implicated in the case only for the reason that they happen to be related to the accused Suresh Rai. It is further submitted that besides the allegations being general and omnibus in nature, no police personnel were injured in the entire occurrence. The allegation of firing is against Raj Kumar Rai and the same is also been made only to give the picture of allegations being serious. The petitioners have no criminal antecedent and undertake to cooperate in the investigation/trial.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioners in the F.I.R together with the petitioners not having any criminal antecedent, it is directed that all the seven petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Mahua P.S. Case no. 169 of 2025 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
