The petitioner is in custody in a case registered under Sections 363, 366(A), 493/376 of the Indian Penal Code and Sections 4 and 6 of P.O.C.S.O.Act, 2012.

It is alleged by the informant, namely, Azmeri Khatoon, that on the pretext of marriage, the petitioner exploited her sexually.

It is submitted on behalf of the petitioner that the petitioner is in custody since 04.07.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. From perusal of paras 12, 13, 14,

Patna High Court Cr.Misc. No.41409 of 2015 (3) dt.30-10-2015 2/2 15 and 16 of the case diary it would appear that the victim has married to the petitioner and she is residing with her in-laws. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. District and Sessions Judgecum- Special Judge, West Champaran at Bettiah in Nautan P.S.Case No. 178 of 2015.
