Kundra, learned Standing Counsel No.24, appearing on behalf of the State-respondents. Considering the fact that the First Information Report, which has led to the registration of Basopatti Police Station Case No.62 of 2016, under Section 376 of the Indian Penal Code, contains allegation of commission of rape on the informant by the petitioners, this Court is clearly of the view that in the circumstances indicated hereinbefore, the First Information Report cannot be quashed.
Confronted with the above situation, Mr. Bimal Kumar, learned Counsel for the petitioners, seeks permission to withdraw this application with liberty to approach this Court with appropriate application in future.
