The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A and 323 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

It is a case of cruelty subjected to the Opposite Party No.2 due to non-fulfilment of dowry demand.

It would not be out of place to mention here that notice has been served to the Opposite Party No.2 for keeping her stand after appearing in this Court but she did not turn up in spite of service of notice.

Patna High Court CR. MISC. No.33317 of 2020(11) dt.28-07-2022 2/2 It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that on the pretext of this and other, the Opposite Party No.2 Khusbu Kumari, wife of the petitioner is not interested to live with this petitioner as wife. A supplementary affidavit has been filed on behalf of the petitioner, in which at para-4, it is stated that on enquiry, it was found that the Opposite Party No.2 has solemnized the marriage with one Ritesh Singh, resident of village- Mohanpur, P.S. Bikramganj, Rohtas and residing with him somewhere.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bhojpur at Ara in connection with Pawana Case No. 18 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
