The petitioner seeks bail in anticipation of his arrest in connection with Sadar P. S. Case No. 319 of 2020, dated 05.09.2020, instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Patna High Court CR. MISC. No.33027 of 2020(2) dt.03-03-2021 2/3 6.75 litres of liquor is said to have been recovered from the shop of co-accused Devashish Ghose. The petitioner is not related to the aforesaid Devashish Ghose and he is sought to be prosecuted in this case because of the accusation against him of having run away from the place of raid.

The petitioner does not have any criminal antecedents and there is no recovery from his constructive / exclusive possession.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Purnea, in connection with Sadar P. S. Case No. 319 of 2020, subject to the conditions as laid down under

The application stands allowed.
