15-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Gopalpur P.S. Case No. 106 of 2018, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, all the FIR named accused persons surrounded the informant and co-accused Sk.Julfikar caused fire-arm injury on chest and abdomen of the informant, whereas, this petitioner and co-accused Sk.Manir caused fire-arm injury on the left thigh of the informant. It is submitted on behalf of petitioner that there is case and counter case. Admittedly, there is land dispute between the parties since long. It is further submitted that as per F.I.R., the petitioner and co-accused Sk.Manir are said to have fired on the

Patna High Court CR. MISC. No.45243 of 2021(2) dt.15-11-2021 2/2 lift thigh of the informant, but as per injury report, no injury has been found on the thigh of the informant. Petitioner is in custody since 08.01.2021. Chargesheet has already been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 106 of 2018.
