The petitioner seeks bail in a case under Section 307 and other sections of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected vide order dated 12.01.2015 passed in Cr. Misc. No. 31267/2014. There is specific allegation that it was the petitioner who fired and the shot hit on the head of Amit Kumar causing his death on the spot.
Of course, the informant and his grand-son came across the firing line while the petitioner and others were quarreling with each other, but at this stage, I am not inclined to enlarge the petitioner on bail in Kothi P.S. Case No. 100 of 2013, corresponding to S. Tr. No. 326/14. Accordingly, the same is rejected.
Patna High Court Cr.Misc. No.39099 of 2015 (2) dt.23-09-2015 2/2 The trial court is directed to expedite the trial and conclude the same within six months from the date of receipt / production of this order holding the trial on day-to-day basis. If the trial is not concluded within the above period, the petitioner may renew his prayer for bail.
