Petitioner is not named in the first information report but in course of investigation, some witnesses claimed to have seen the petitioner and others going towards the place of occurrence just prior to alleged occurrence and after that one co-accused Md Farooque was arrested and made his confessional statement disclosing the involvement of the petitioner in the alleged crime. Co-accused Md Farooque has already been granted privilege of bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ranvijay Kumar, Judicial Magistrate, Ist Class, Purnea/ concerned court in Kasba P.S. Case no.
