2. The petitioner is apprehending his arrest in connection with Singeshwar P.S. Case No. 226/2023 registered for the offences punishable under Sections 147, 149, 353, 431, 504 and 114 of the Indian Penal Code.

3. As per prosecution case, petitioner and others are said to have blocked the road on account of shifting the temple in order to widen the highway.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR. The petitioner bears no criminal antecedent. He further submits that there is no specific allegation against the petitioner rather the allegation is general and omnibus in nature.

Patna High Court CR. MISC. No.36535 of 2025(3) dt.04-09-2025 2/3 The petitioner is a local jeweler of the area where the occurrence took place and therefore his name has been surfaced in the FIR. The petitioner has nothing to do with the alleged occurrence and the petitioner is not apprehended on the spot. He further submits that on similar and identical allegation co-accused Suraj Singh @ Suraj Kumar Singh @ Govind Kumar and Rakha Devi and Ors. have already been granted anticipatory bail by the coordinate Benches of this court vide Cr. Misc. No. 41988/2025 and Cr. Misc. No. 74635/2024 respectively and on the principle of parity the petitioner deserves anticipatory bail.

5. The learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner.

6. Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singeshwar P.S. Case

Patna High Court CR. MISC. No.36535 of 2025(3) dt.04-09-2025 3/3 No. 226/2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. However, if the petitioner is found involved in similar nature of offences in future, the learned trial court shall be at liberty to cancel his bail bond.

8. The application stands allowed.
