The petitioners apprehend their arrest for the

Patna High Court CR. MISC. No.45231 of 2021(2) dt.12-04-2022 2/3 offences alleged under Sections 341, 323, 379, 307 and 34 of the Indian Penal Code, registered in connection with Pirbahore P.S.Case No.237 of 2016.

The informant and the petitioners are the students of Patna Science College. As per FIR, when the informant along with his friends Aditya Singh and Ravi Ranjan were moving towards their house after attending their classes and reached near A-D block, the petitioners asked them to come to Chemistry ground where the petitioners and 10 unknown boys surrounded them and assaulted them. The specific allegation against the petitioner Banti @ Pratik is that he assaulted the informant with butt of the pistol and the petitioner Aryan Raj snatched Rs. 4000/- from the informant and a mobile phone and Rs.2000/- from the informant's friend Aditya Singh. The learned counsel for the petitioners has submitted that they are the persons of clean antecedents. He has also submitted that both the petitioners are students. Although, the injury was mentioned in the order of the learned court below, but the nature whereof has not been mentioned.

Considering the above facts and circumstances, specially the clean antecedents of the petitioners, let the

No.45231 of 2021(2) dt.12-04-2022 3/3 petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of C.J.M. Patna in connection with Pirbaharo P.S.Case No. 237 of 2016,subject to the conditions as laid down under Section 438(2) Cr. P.C. with further conditions that they shall file an affidavit before the court below that they shall not indulge in such crime in future.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
