Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Bijay Bhushan Prasad, learned counsel for the petitioner and Mr. Anil Kumar, learned APP for the State.

The petitioner seeks bail in connection with Goraul P. S. Case No. 298 of 2009 dated 06.12.2009, instituted for offence under Section 379 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and his name has transpired on the confession of a co-accused who now has been granted bail.

In all other cases, in which the petitioner was

Patna High Court CR. MISC. No.33546 of 2020(2) dt.16-12-2020 2/2 earlier made accused, he has been granted.

The petitioner is in custody since 04.08.2020. Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Goraul P. S. Case No. 298 of 2009.

The petition stands allowed.
